Terms of Service

These Terms of Service ("Terms") govern your access to and use of the ExtractData website and service (the "Service") operated by ExtractData ("we", "us", or "our"). By creating an account or using the Service, you agree to be bound by these Terms.

1. Acceptance of Terms

By accessing or using ExtractData, you confirm that you are at least 18 years old, that you have the authority to agree to these Terms on behalf of yourself or the organization you represent, and that you will comply with all applicable laws and regulations when using the Service.

2. Description of Service

ExtractData is a local business data extraction tool that aggregates publicly available business information from Google Places, Yelp, Outscraper, SerpAPI, and business websites. We provide this data through a web dashboard, along with AI-powered features including cold email generation, business health scoring, and market reports. Features available to you depend on your subscription tier.

3. Account Registration

You must provide accurate, current, and complete information when registering. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Notify us immediately at hello@extract-data.com if you suspect unauthorized access.

4. Plans & Billing

ExtractData offers a Free plan and paid Pro and Agency subscriptions. Paid plans are billed monthly or annually in advance. By subscribing, you authorize us to charge your payment method on file via Stripe for the applicable fees.

  • Auto-renewal. Subscriptions renew automatically until canceled. You can cancel at any time from your dashboard; cancellation takes effect at the end of your current billing period.
  • Free trial. Pro and Agency plans include a 7-day free trial. You will not be charged during the trial period. Cancel before the trial ends to avoid charges.
  • Refunds. We offer a 14-day money-back guarantee on your first paid month. After that period, fees are non-refundable except where required by law.
  • Price changes. We may change subscription prices with 30 days' notice via email. Changes take effect at your next renewal.
  • Taxes. Prices exclude applicable sales tax, VAT, or GST, which will be added at checkout where required.

5. Acceptable Use

You agree not to use ExtractData to:

  • Resell, redistribute, or republish bulk data extracted from the Service as a competing product or dataset.
  • Send unsolicited commercial emails ("spam") in violation of CAN-SPAM, CASL, GDPR, or any applicable anti-spam law.
  • Harass, defame, or harm any business or person with the data you extract.
  • Attempt to reverse engineer, scrape, or bypass rate limits on the Service itself.
  • Share your account credentials with multiple people — each user must have a separate account.
  • Use the Service for any unlawful purpose, including discrimination prohibited by applicable law.

We reserve the right to suspend or terminate accounts that violate these rules, with or without notice.

6. Data Rights & Third-Party Content

The business data surfaced by ExtractData is publicly available information sourced from Google Places, Yelp, and business websites under their respective licenses and terms. You are responsible for complying with those third-party terms when using the data (for example, Google's prohibition on permanently storing Places data, or Yelp's attribution requirements). When in doubt, refresh data through the Service rather than building long-term databases.

7. Intellectual Property

ExtractData, including the website, software, branding, and documentation, is owned by us and protected by copyright, trademark, and other intellectual property laws. We grant you a limited, non-exclusive, non-transferable license to use the Service for your internal business purposes during your subscription. All rights not expressly granted are reserved.

Any feedback, suggestions, or feature ideas you submit may be used by us without obligation or compensation.

8. Termination

You may cancel your subscription or delete your account at any time. We may suspend or terminate your access if you violate these Terms, if your account is delinquent, or if required by law. Upon termination, your right to use the Service ends immediately, and we may delete your data after the retention period described in our Privacy Policy.

9. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that business data surfaced will be accurate or complete. Data accuracy depends on third-party sources we do not control.

10. Limitation of Liability

To the maximum extent permitted by law, ExtractData and its officers, employees, and affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, including lost profits, lost data, or business interruption, arising from your use of the Service. Our aggregate liability for any claim arising out of these Terms or the Service will not exceed the amounts you paid to us in the 12 months preceding the claim.

11. Indemnification

You agree to indemnify and hold ExtractData harmless from any claims, losses, or damages arising out of your use of the Service, your violation of these Terms, or your violation of any third-party rights — including, without limitation, any outreach or marketing activity you conduct using data extracted via the Service.

12. Governing Law

These Terms are governed by the laws of the State of Delaware, United States, without regard to its conflict-of-laws principles. Any dispute arising from these Terms will be resolved exclusively in the state or federal courts located in Delaware, and you consent to the personal jurisdiction of those courts.

13. Changes to These Terms

We may update these Terms from time to time. Material changes will be announced via email or in-app notice at least 14 days before taking effect. Continued use of the Service after the effective date constitutes acceptance of the updated Terms.
